A discreet camera is a tool, and the law generally cares about the recording activity, not the shape of the thing doing the recording. The general rule: reasonable expectation of privacy

Most legal systems, from the US to the EU to Australia, hinge on whether the person being recorded had a "reasonable expectation of privacy" in that space. Recording in your own living room is very different, legally, from recording in a bathroom, changing room, or someone else's private bedroom — the latter is illegal essentially everywhere, regardless of intent.

Video vs. audio: why audio has stricter rules

Video-only recording in your own home or business is broadly permitted in most places. Audio recording is a different story: many US states require two-party (all-party) consent to record a conversation, meaning everyone being recorded must know about it — recording audio without consent can carry criminal penalties even when the video portion would have been fine on its own. If your camera captures audio, treat that feature with the same caution as the video, and check your specific state or country's wiretapping laws.

Common lawful use cases

• Your own home or property: monitoring for security, package theft, or break-ins on property you own or rent
• Childcare or eldercare supervision: many parents use a discreet camera to check on a caregiver's conduct — best practice (and required in some regions) is to disclose that a camera may be in use, even if its exact location isn't specified
• Business security: commonly allowed with visible signage disclosing that recording may occur, particularly for audio
• Personal safety and travel: recording your own point of view in public spaces where you don't have an expectation of privacy

What's never okay

Regardless of jurisdiction, using a hidden camera to record someone in a bathroom, changing room, hotel room, or other clearly private space without their knowledge is illegal nearly everywhere and can carry serious criminal penalties.
